From our Cleveland sister station WOIO:

MIAMI (WOIO) - Cleveland Browns wide receiver Donte Stallworth has been charged with DUI manslaughter. A Thursday morning court hearing has been scheduled.

The hearing, set to take place in a Miami-Dade Courtroom. Stallworth is accused of fatally striking a pedestrian with his Bentley in Miami last month.

59-year-old Mario Reyes was killed in the accident. Reyes worked in the area and was headed to a nearby bus stop when he was struck down.

Late Wednesday, the family of Mario Reyes released the following statement:

The family is encouraged by the fact the criminal investigation surrounding Mr. Reyes' tragic death is proceeding. The family will continue to fully cooperate with law enforcement and the authorities to bring this case to an appropriate resolution. The family is still in a state of shock and continue to grieve the loss of Mr Reyes. Therefore, the family reiterates their request that the media and others respect their privacy during this very difficult time.

The Miami Herald and Miami TV stations have reported that Stallworth's blood alcohol level was above the legal limit.

The police report states that Reyes was not in the crosswalk but also states that careless driving contributed to the deadly accident.

If convicted of DUI manslaughter, Stallworth could face up to a maximum 15-years in jail.
