WATERVILLE TOWNSHIP, OH (Toledo News Now) - A report from the Ohio State Highway Patrol says no brake was hit in the deadly crash involving a student driver and his instructor at the end of April.

An investigation is still under way as to if the brake was hit and if there was a malfunction.

The OSHP says the instructor's car had passed its annual safety inspection.

Joseph Franks, 16, and his driving instructor Thomas Smith, 48, both died in the crash after he failed to stop at a stop sign and struck a van. A 48-year-old woman in the other vehicle was treated for minor injuries at a Toledo hospital.

A donation fund has been set up through Huntington Bank for Joseph's family to cover burial and funeral costs. Donations may be made at any Huntington location.
