Federal court upholds FTC ruling ProMedica must divest St. Luke's Hospital

MAUMEE, OH (Toledo News Now) -

A federal judge has upheld a previous ruling by the Federal Trade Commission that ProMedica must divest St. Luke's Hospital.

ProMedica bought the hospital in 2010. In March of 2012, the FTC ruled that the purchase violates anti-trust laws. The FTC ordered ProMedica give up control of the hospital to remedy the anti-trust violation.

ProMedica appealed the decision, and the 6th Circuit upheld the FTC decision on Tuesday.

ProMedica released the following statement on the decision:

We are extremely disappointed by today's decision and intend to appeal. We are committed to exhausting all of our legal options.   

As we continue this legal journey, we would like to emphasize that St. Luke's Hospital remains a member of ProMedica, continues to serve patients, and all health plans currently accepted at St. Luke's will continue to be accepted. 

For the time being, nothing will change for patients who visit St. Luke's. The same insurance will still be accepted there until the legal process is complete.

A legal team representing ProMedica says the health system will not close the hospital. If forced to, ProMedica would sell the hospital or spin it off into a private hospital.
