The legal rights to protect your child from school bullies

AKRON, OH (WOIO) -

A beat down of a 10-year-old student at Betty Jane Community Learning Center in Akron has prompted change.
Students attest a lot of bullying occurs on school grounds.
In this particular incident 10-year old Jayden Spicer got into a rumble with a group of male classmates.
Spicer recalls,  "I was trying to defend my brother."

Instead, he emerged from the heated scuffle with black eyes and a fractured nose.

He was beaten by the group of boys on a hidden path next to the elementary school.

Jayden's mom took action and is using the incident to secure the area with the help of school officials.

Daniel Rambler of Akron Public Schools says "The School has responded by having additional staff monitor the students as they go out."

Spicer points out, "Had there been adult supervision I think this could have been prevented."

Parents should take these steps if you believe your child is being bullied.

First, alert school officials and let them extinguish the friction.

If that move isn't successful, you do have legal rights.

Ian Friedman a partner with Friedman & Frey advises, "You could go file what's called a civil protective order. Go to court and ask the court to keep that bully away from your child."

If a protective order isn't effective you can file a civil lawsuit.

The most important component to remember when faced with a bully is that you do not take matters into your own hands and confront a bully.

Instead, take advantage of the system to protect yourself and more importantly, your children.
