2nd lawsuit filed in double-fatal bridge construction accident

MONTGOMERY, AL (WSFA) -

Families of the two victim's who died in an industrial accident at the Montgomery Outer Loop bridge project Wednesday have filed wrongful death lawsuits.

David Lee White, 63, and Birmingham resident Lomax Phillips, 53, died when the wagon lift they were in separated from the side of a bridge and fell more than 90 feet to the ground.

A suit was filed in Montgomery County Circuit Court Friday morning on behalf of David and Shania Mahone, listed as dependents and heirs of White.

Another lawsuit was filed in Jefferson County Circuit Court Friday night on behalf of Lomax Phillips' wife, Lisa Phillips, and his children, Deborah Phillips, Lomax Phillips Jr., Deangila Phillips and Keira Phillips.

Bessemer-based R.R. Dawson Bridge Company, LLC., Miller Formless Systems, and other currently unknown entities are named as defendants in the wrongful death suits.

The suit accuses Dawson Bridge Company and Miller Formless Systems of negligence in the death and seeks compensation.

Phillips' lawsuit also named Phillips' supervisor, Samuel Poynter, as a defendent.
