TPD trying to close down Upton Bar and Grill

TOLEDO, OH (Toledo News Now) -

Toledo Police have hit a roadblock for a bar they've been trying to close down after years of crime.

A judge has approved a motion to close the Upton Bar and Grill for a year because of its history of crime, but an appeal could mean the bar stays open a little longer.

Over the last couple years, Toledo Police say they have had calls from neighbors complaining about things such as noise, litter and public urination, among more troublesome crimes.

"We've even had a lot of problems with more serious crime – drug dealing out of the bar, sometimes by bar employees," said Sgt. Joe Heffernan. "We' had shooting happen over there."

This summer, two people were taken to the hospital after being shot outside the bar.

Police filed an injunction to close the bar, which was granted for a year, but the owner of the building has appealed that ruling. That means they can stay open until the case is heard by an appeals court, but Heffernan is confident the bar will eventually be closed.

"I'm confident that once that last appeals court hearing is done, that we'll have it closed down and the neighbors can rest peacefully over there," he said.

Sgt. Heffernan says the appeal should be heard within the next month.
