2 Southview teens charged with rape, kidnapping in court

SYLVANIA, OH (Toledo News Now) -

Two Southview High School students accused of rape appeared in court Tuesday.

The students, ages 17 and 14, appeared in court with their parents and attorneys. Defense Attorney Ronnie Wingate asked the judge to reconsider sending his 14-year-old client back to the juvenile detention center, asking her to consider his age and his clean background.

"Both of his parents are here, have been here on every occasion," Wingate said. "If the court wishes to have this individual have no contact with the alleged victim, with any potential witnesses, that all can be made a part of the release."

Judge Connie Zemmelman denied the request.

"The issue of feeling like the community is safe in light of the serious nature of the allegation plays a greater role, because I don't have really any strong consequence that could be imposed if he chose to violate the order," the judge said.

The 14-year-old will remain held in the Lucas County Juvenile Detention Center on rape charges. The 17-year-old will be held at the same location on rape and kidnapping charges.

A motion to suppress hearing will be held Oct. 22. Wingate requested that certain evidence be excluded from consideration by the judge or jury at trial.
