City of Akron ordered to re-hire firefighter and pay him $251,421.91


When  the Ohio State Legislature changed the residency requirements, Akron Mayor Don Plusquellic threatened to fire City employees who chose to live outside the City.  

Akron Firefighter Tim Semelsberger believed that Plusquellic was not above the law and exercised his right to choose where to raise his children.

Plusquellic retaliated by firing him.  

IAFF Local 330 stood by Semelsberger and chose to arbitrate the wrongful firing.  

After a 5 year battle, the Arbitrator ruled for IAFF Local 330 and Semelsberger was ordered reinstated with seniority and pay.  

Although Akron reinstated Semelsberger, the City refused to pay back wages of $251,421.91 and appealed the arbitration order to the Summit County Court of Common Pleas.

On Monday, in Case No. CV 2012-08-4617, Judge Parker upheld the arbitrator's ruling vindicating Semelsberger and confirmed the award of back pay and reinstatement.
