City sues owners of former Southwyck Mall

TOLEDO, OH (Toledo News Now) -

The City of Toledo is suing the owners of the former Southwyck Mall property, claiming the city is owed more than $30,000.

The former mall was demolished in 2009, and now the city says that property has become a major nuisance. In a lawsuit filed this week in Lucas County Common Pleas Court, the city claims it is owed more than $21,000 for grass and weed cutting, and more than $11,000 for unpaid storm water bills.

Rick Akeman, manager of Toledo's Beautification Action Team, says city crews have worked on that property three times this year.

"I bring a whole crew, two tractor drivers, four laborers and I have another individual who has a pesticide/herbicide license," he said. "We try to keep the weeds down. The moment we let this go, the weeds and grass would be 10 feet high. With anything that high, it'll harbor rodents and it also encourages illegal dumping."

Councilman Mike Collins, who's challenging Mayor Bell in his re-election bid, says the lawsuit has the potential to ruin any chances of redevelopment.

"The principles of Southwyck have to make a business decision. Are they going to do the developing, or are they going to sell the property?" Collins said. "I know right now I can say they have plans to figure out what's the best way to market. On top of that, I'm the district council member. You'd think he'd give me the common courtesy to tell me what's going on."
