TOLEDO, OH (Toledo News Now) -

One case of a nationwide cyclospora outbreak hit right here in Toledo. Now the man who says he contracted the parasite from an Olive Garden in May is suing the restaurant.

The Centers for Disease Control and Prevention became aware of the cyclospora outbreak at the end of June. Hundreds of cases have been confirmed nationwide.

"There's over 500 people that have been affected by this, and the departments of health tracked it back to a farm in Mexico," said Martin Williams, Licensed Practicing Attorney with Williams DeClark Tuschman, Co.

Williams is representing Justin Haren, who is suing Olive Garden as well as Taylor Fresh Foods, the farm in Mexico where the infected lettuce came from.

Williams says Haren is still very ill and has yet to return to normal life.

"The problem with this parasite is that it takes awhile to get rid of it," he said. "He's still having a lot of problems, and that's another reason for the lawsuit, as well, is that this is going to go on for awhile."

Haren's lawsuit is the first in Ohio, but there are currently about six others across the country.

Williams says those in the food service industry have to be held responsible, and need to make sure the foods they supply are safe.
