Police: Guard shot man at south Toledo bar in self defense

TOLEDO, OH (Toledo News Now) -

Marvin Smith, Jr., died after being shot three times outside the Lighthouse Bar on Broadway in south Toledo, but the man who shot him is not currently facing charges.

Police say an altercation Sunday inside the bar spilled out to the parking lot and ended with two men firing shots.

A security guard shot and killed 24-year-old Smith, but police say he acted in self defense.

"Smith had not only shot one security guard, but he was shooting at people in the crowd, and directly at the other security guards that were armed," said TPD Sgt. Joe Heffernan.

Neighbors are still stunned by what happened.

"We don't have things like that happening in this neighborhood," said William Block. "We have car accidents and such like that, but nothing like killing or shooting or whatever."

Police say Smith was part of the altercation inside the bar, and was escorted out by bouncers.

"He took exception to what was going on, went to his vehicle, retrieved a pistol, went back up towards the bar where there was an unarmed security guard at the door, shot him twice," Heffernan said.

That's when police say Smith turned his gun on the crowd.

"At that point, there were two armed security guards in the lot. They heard the shots going off, went towards Mr. Smith," Heffernan said. "Smith actually turned towards them and fired at least two rounds towards their direction."

Police say that's when a guard fired back and hit Smith, killing him.

Although no charges are currently pending against the security officer, a state agency is checking to make sure his license was up to date.
