Family involved in botched kidney transplant sues UTMC

TOLEDO, OH (Toledo News Now) -

A family has filed a lawsuit against the University of Toledo Medical Center over a botched kidney transplant.

In August of 2012 a nurse accidentally threw away a good kidney during a live donor transplant.

Sarah Fudacz, 24, was to receive the kidney from her younger brother. The Fudacz family filed suit against the hospital on Monday. It is unclear exactly what is sought in the suit at this time.

One nurse was fired and another suspended as a result of the incident. A surgical center manager was also put on a leave, but later reinstated.

The University of Toledo Medical Center released the following statement about the lawsuit:

"The University of Toledo Medical Center has created a unique environment of safety in our transplant and other programs that is second to none. Other hospitals and transplantation programs across the region and the country continue to learn from our experiences to improve patient safety and provide the highest levels of care.

 "We are aware that a lawsuit has been filed. While we cannot discuss the specific health of our patients or pending litigation, we remain saddened by this unfortunate situation and express our deepest feelings to our patients and their families.

"Out of this difficult situation health care quality and patient safety has been dramatically transformed."
