Council votes in favor of Perrysburg pub patio

PERRYSBURG, OH (Toledo News Now) -

After a long battle in Perrysburg over a popular restaurant's outdoor space, city council has voted to allow the Fifth Street Pub to use their patio.

Since the restaurant opened in March, neighbors have complained about noise from the patio. In May, the patio was shut down, but restaurant owner Geoff Kies appealed the decision.

On Tuesday, council overturned the original ruling, with some restrictions.

"What happened here tonight set a good example for everybody," Kies said. "I put a lot of compromises up from my side, and, of course, the council let me use the patio."

The patio will have restricted hours. Monday through Thursday, it must be cleared by 9 p.m., Fridays and Saturdays by 10 p.m. During the school year, those hours will be 8 p.m. and 9 p.m.

The space also must be enclosed by October.

"Ultimately, we ended with a good compromise and I think we could have done this a long time ago," Kies said. "But today it worked out, and hopefully we'll get the rest of the summer under our belt with no more problems."

But some residents are still against the patio.

"I know he's doing his best, but he's not there 24/7, and I don't know if he's got people in place to enforce these laws," said resident Josh Alkire. "What happens if it's 10 o'clock and there are people out there? What are we, the residents, supposed to do?"

Kies is also willing to only use half the patio. By restricting the number of patrons outside from 49 to 24, the noise should be reduced.
