Toledo officer will not be charged after fatally shooting suspect

TOLEDO, OH (Toledo News Now) -

A grand jury has decided a Toledo police officer will not be charged after he shot and killed a suspect during a fight.

According to the grand jury's report:

"In the matter of the criminal investigation into the death of Darrell Parnell, no further investigation is needed."

Police say officer Ben Cousino and his partner, Jesuse Cordero, were investigating the break-in of a Jeep back in September 2012. They say Darrell Parnell, 19, resisted and ran. When police caught up with him, there was a struggle and Cousino shot Parnell once in the chest.

Police Chief Derrick Diggs says the shooting review of the incident found officers Cousino and Cordero were justified in the shooting. Both were returned to normal duty at that time. 

The grand jury action means there will be no criminal charges against the two. The family of Parnell could file a civil complaint against the city and the officers, but so far, has not.
