The Fort Thomas woman who was convicted of shooting and killing her husband is asking for a new trial.

Cheryl McCafferty was convicted in 2009 of first degree manslaughter for killing her husband, Bob, in their Fort Thomas home in 2007.

McCafferty's new attorneys have filed paperwork asking for a new trial, claiming ineffective counsel from her previous team. 

"To come back three years after the fact and allege that, I really don't think its going to go anywhere," said FOX19 legal analyst, Mike Allen. "I was in the courtroom for almost every day of that trial and her two defense lawyers really did a good job. They got the jury to come back with a verdict of manslaughter as opposed to murder."

McCafferty was sentenced to 18 years in prison, but was deemed a victim of domestic violence by the court, meaning she could have only served 20 percent of her sentence. She was denied her first attempt at parole in January of last year, and will be eligible again 60 months from then.

As part of her sentencing agreement, she could not appeal her conviction, but she can ask for a new trial.
