State wants Oregon man indicted of murder competency tested

TOLEDO, OH (WTOL) - A hearing to discuss the competency of an Oregon man indicted for the murder of his girlfriend's husband is expected to happen on Friday.

The State wants to test Shawn Brazeal's competency because his attorney is claiming that Brazeal did not understand his right to remain silent because he only has an I.Q. of 53. The average score is 100.

Prosecutors say if Brazeal is competent to stand trial then he should have been competent to understand his Miranda Rights.

Brazeal's attorney is fighting the competency evaluation.

Court records show that Brazeal admitted that he and his girlfriend, Janelle McGuire, killed her husband Devin McGuire by repeatedly stabbing him in the chest back in August of 2011.
