Andrew Z arraigned on theft, failure to pay sales taxes charges

PERRYSBURG, OH (WTOL) - Kiss FM morning DJ Andrew Zepeda as well as his uncle, Paul, faced a judge Friday afternoon in Wood County.

The two are accused of involvement in a break-in at Andrew's closed pizza restaurant at Levis Commons. The restaurant was shut down in September for failure to pay rent.

Andrew Zepeda has been off the air at 92.5 Kiss FM since mid-November, when he was indicted on charges theft and failure to pay sales tax related to his closed Levis Commons pizzeria.

Andrew Zepeda pleaded for intervention in leu of conviction.

If the state accepts his plea, Zepeda would enter into a deal where he promises to pay the state sales taxes that he owes. This would divert his jail time and the offense would be off his record once he has paid in full.

Andrew Zepeda's uncle, Paul Zepeda and another man, David Wright were arrested last month for breaking into Andrew Z's sports pizzeria.

Paul Zepeda pleaded not guilty.

Andrew Z has maintained his innocence and says he is being framed.

If convicted, Zepeda faces up to 18 months in jail for each count. He's also charged with complicity to breaking and entering which carries a maximum of one year behind bars.

Zepeda will appear in court again Jan. 28, while his uncle will appear Jan. 14.
