Toledoan continues fight against trash fee

TOLEDO, OH (WT0L) - One Toledoan is continuing her fight against the City of Toledo's refuse collection fee, even though city council may soon lower the charge.

When the city began charging property owners for trash and recycling collection, Toledo resident Karen Shanahan filed a lawsuit.

She says the fee is a tax and that it violates the city charter because it was never placed on the ballot and approved by voters.

Shanahan says her attorney is going to file a motion aimed at including all Toledo home owners in a class action lawsuit later this month.

"They're saying it's a fee it isn't a fee because it's being billed unilaterally against every property owner whether the service is used or not and that's why it isn't legal," said Shanahan. "It's right in the city charter if they want to raise taxes you have to put it on the ballot; you have to vote on it."

The mayor's office has not yet commented on the suit.

Toledo City Council will likely approve lowering the monthly trash fee on Tuesday in response to voters approval of Issue 5. The fee was raised to $15 per month in March because of the city's budget crisis.
